Tomorrowland Presents CORE Melbourne — Refund & Ticketing Policy.

Clause 0

Overview

By purchasing a ticket to Tomorrowland Presents CORE Melbourne (the “Event”), you agree to the following terms. Nothing in this policy excludes any right or remedy that cannot be excluded under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law, or applicable Victorian legislation.

Clause 1

No Refunds

All ticket sales are final. Tickets are non-refundable and non-exchangeable in all circumstances except where Australian Consumer Law expressly requires otherwise. No refund, credit, or exchange will be issued for any reason not required by law, including but not limited to:

  • (a)Change of mind
  • (b)Illness or injury of the ticket holder
  • (c)Travel delays or disruptions
  • (d)Work commitments
  • (e)Personal circumstances
  • (f)Adverse weather conditions where the Event proceeds
  • (g)Dissatisfaction with any Event element not constituting a major failure under Australian Consumer Law
  • (h)Failure to attend for any reason

Clause 2

Event Cancellation

If the Event is cancelled entirely and not rescheduled, ticket holders will be entitled to a refund of the base ticket price only, in accordance with Australian Consumer Law. “Base ticket price” means the face value of the ticket as listed at the time of purchase, exclusive of all booking fees, transaction fees, delivery fees, and service charges. This entitlement applies regardless of the cause of cancellation, including circumstances beyond the Event Organiser’s reasonable control. Refunds will be issued to the original purchaser via the original payment method where practicable.

The following are non-refundable in all cancellation scenarios unless Australian Consumer Law expressly requires otherwise:

  • (a)Booking fees and transaction fees
  • (b)Delivery charges
  • (c)Travel and accommodation costs
  • (d)Merchandise purchases
  • (e)All other ancillary expenditure

Note on booking fees: Where a booking or transaction fee is charged as a mandatory, non-optional condition of purchase, the Event Organiser will assess refund eligibility for that fee on a case-by-case basis in the event of cancellation, in accordance with ACCC guidance and Australian Consumer Law.

Clause 3

Event Rescheduling

If the Event is rescheduled, all tickets automatically transfer to the new date. No refund will be available solely because a ticket holder is unable to attend the rescheduled date, except where Australian Consumer Law requires otherwise. Where a refund entitlement arises, requests must be submitted within 14 days of the date on which the rescheduling is announced. This window will not be extended except where Australian Consumer Law requires otherwise.

Clause 4

Artist and Programming Changes

The Event Organiser expressly reserves the right to change, substitute, remove, or cancel any artist, performer, act, speaker, vendor, sponsor, production element, running order, performance time, or programming at any time without notice and without liability.

No such change will entitle a ticket holder to a refund, credit, or exchange unless it constitutes a major failure under Australian Consumer Law. For the purposes of this policy, a “major change” means a change that results in cancellation of all or substantially all of the acts listed as performers in the Event program at the time tickets first went on sale, such that the Event no longer reflects the program as advertised at the time of purchase.

The cancellation, substitution, or non-appearance of any individual artist or group of artists, regardless of their billing prominence, does not by itself constitute a major change.

Ticket holders acknowledge at the time of purchase that:

  • (a)The ticket is purchased for the Event as a whole, not for the performance of any specific artist;
  • (b)The Event program collectively constitutes the entertainment and experience offered;
  • (c)Artist lineups for multi-act events are subject to change; and
  • (d)This acknowledgement is made in full awareness that any artist featured in Event marketing may not ultimately perform.

Important: The above definition of major change governs refund eligibility regardless of which artists are featured in Event marketing materials. Marketing materials reflect the lineup at time of publication only and do not constitute a guarantee of performance.

Clause 5

Point of Purchase Acknowledgement

The ticketing platform will require all purchasers to affirmatively confirm, by checkbox or equivalent mechanism at the time of purchase, that they have read and agree to this Refund and Ticketing Policy, including the acknowledgements in Section 4. Purchase cannot be completed without this confirmation. Ticket holders who complete a purchase are deemed to have read, understood, and agreed to all terms of this policy.

Clause 6

Weather

The Event proceeds rain or shine. No refund will be issued on account of weather conditions, including extreme weather, unless the Event is cancelled or a major change occurs as required under Australian Consumer Law. Attendees are encouraged to prepare for all weather conditions.

Clause 7

Force Majeure

The Event Organiser accepts no liability for cancellation, postponement, interruption, or modification caused by circumstances beyond its reasonable control, including pandemic, public health emergency, government direction, natural disaster, civil unrest, terrorism threat, utility failure, or venue closure.

In such circumstances, the Event Organiser may, at its sole discretion, offer a ticket transfer to a rescheduled date, an event credit, or an alternative remedy. Any refund entitlement is determined solely by Australian Consumer Law, including where such entitlement arises from a cancellation caused by force majeure circumstances. This clause does not limit or exclude any statutory refund right that would otherwise apply.

Clause 8

Refund Process

Where a refund is required by law, requests must be submitted through the authorised ticketing provider at the refund submission URL published on the Event website within 14 days of the date on which the cancellation or major change is announced by the Event Organiser. This window will not be extended except where Australian Consumer Law requires otherwise. The Event Organiser reserves the right to require proof of purchase and identity verification before processing any refund. Late requests will not be accepted except where required by law.

Clause 9

Resale

Tickets may only be resold through platforms expressly authorised by the Event Organiser. Tickets obtained through any unauthorised channel are void from the point of purchase and confer no rights or entitlements under this policy or under any agreement with the Event Organiser. Any such ticket will be cancelled without refund and refused entry. Entry will not be granted to any person presenting a cancelled or void ticket, regardless of the price paid or the circumstances of purchase.

Clause 10

Governing Law and Disputes

This policy is governed by the laws of Victoria, Australia. Any dispute arising under or in connection with this policy is subject to the exclusive jurisdiction of the courts of Victoria. Nothing in this clause limits any right a consumer may have to bring a claim before the Victorian Civil and Administrative Tribunal (VCAT) or any other tribunal or body with statutory jurisdiction over consumer disputes.

Clause 11

Consumer Rights

Nothing in this policy excludes, restricts, or modifies any right or remedy available under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law, or any applicable Victorian legislation. Where any term of this policy is inconsistent with a statutory right that cannot be excluded, that term is void to the extent of the inconsistency.

This Policy has been prepared with reference to the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)), the Australian Consumer Law and Fair Trading Act 2012 (Vic), and guidance published by Consumer Affairs Victoria and the Australian Competition and Consumer Commission.
